Article XVI — General and Miscellaneous Provisions

Section 1

Civil Service

The legislature shall establish a civil service system and shall provide for its administration.

Section 2

Employees' Retirement System

The legislature shall provide for a retirement system for state and county employees and teachers.

Section 3

Disqualifications from Public Office or Employment

No person who has been convicted of a felony by a court of the State or by a federal court and who has not been pardoned or had the person's civil rights restored by a competent authority shall be eligible to hold any office or employment under the State or any of its political subdivisions.

Section 3.5

Salary Commission

There shall be a commission on salaries whose duty it shall be to recommend, from time to time, the salaries of the members of the legislature, the elected state executive officers, the justices of the supreme court and judges of the other courts of record, and the members of the boards of education and trustees of the University of Hawaii.

Section 4

Oath of Office

The following oath shall be taken by each justice and judge of the courts of record, state and county officer and member of the legislature: "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States, and the Constitution of the State of Hawaii..."

Section 5

Intergovernmental Relations

The State may enter into intergovernmental compacts and agreements, as provided by law.

Section 6

Federal Lands

The State of Hawaii does hereby disclaim all right and title to any land or other property not granted or confirmed to the State or its political subdivisions by or under the terms of the Admission Act.

Section 7

Compliance with Trust

The State and its officers shall comply with all obligations under the Admission Act relating to lands and properties granted or conveyed to the State by the Admission Act.

Section 8

Administration of Undisposed Lands

The proceeds and income from the sale or other disposition of lands ceded to the State of Hawaii by the United States under the provisions of the Admission Act shall be used for the support of the public schools and other public educational institutions, for the betterment of the conditions of native Hawaiians as defined in the Hawaiian Homes Commission Act, for the development of farm and home ownership, for the making of public improvements, and for the provision of lands for public use.

Section 13

Plain Language

All laws of the State of Hawaii shall be written in plain language.

Section 16

Provisions Are Self-Executing

The provisions of this constitution shall be self-executing to the fullest extent that their respective natures permit.
